uBiome: Ethical Lapse or Not?

uBiome?s CEO, Jessica Richman, seems to me to be a great saleswoman who also excels at sounding innocent and playing the misunderstood victim in the ethical controversy surrounding her company. I think this was well illustrated in her recent guest blog in Scientific American with Dr. Zachary Apte, co-founder and Chief Scientific Officer of uBiome. The picture is a little less rosy if you look back at the origins and history of the discussions about her company?s perceived ethical lapses.

I was intending to write about uBiome before this, as I was disturbed by Richman?s appearance at TEDMED. Admittedly, I was already put off by her telling twitter handle of ?@venturejessica.? Her hubris was further evidenced by the title of her TEDMED talk, ?Could a citizen scientist win a Nobel Prize?? Fortunately, her talk was a bit more restrained, though still touting the potential of her as yet untested product.

Richman and Apte?s recent blog has shown that they seem to have learned little from the heated discussions about uBiome. Their business is part of the UCSF?s Quantitative Biosciences Institute start-up incubator. While they say that lawyers provided by UCSF told them that they did not require Institutional Review Board (IRB) ethics approval?something that ?didn?t sound like a great system? to them?proceeding without ethical review seems to reflect a lack of understanding of basic research ethics as well as a desire for expediency over more careful volunteer protections.

Richman and Apte complain that? IRBs ?are provided free of charge to members of that [academic] institution? but that? they would have had to pay ?thousands of dollars? for an external IRB review. Welcome to the real world. At the non-academic institution where I did research for ~25 years, there were fees for review. It was accepted as a cost of doing business, an expected start-up investment cost, to cover the administrative costs of the host institution.

uBiome proclaims their innocence because they had not yet processed specimens; they were crowdfunding their project and intending to get IRB approval after that step. But their 2/17/13 e-mail solicitation in Science Citizen Newsletter states ?Please sign up to get your friends or your loved ones? microbiomes sequenced.? Their home page certainly implies benefit: ?Dozens of health conditions are correlated with the microbiome ? from asthma to diabetes, autism to depression, irritable bowel, Crohn?s, chronic sinusitis, heart disease, and more. We help you investigate your personal microbiome and learn how you correlate with others.?For just $89, you can learn what?s in your gut, nose, mouth, skin, ?genitals ? or, sample anything!?

Under ?How it Works,? we learn that ?Our online survey lets you ask and answer questions about your health, lifestyle, demographics, social connections, and more! Then you can see how you correlate with other people in our dataset.? It then states, ?our team will analyze the results to explore scientific research questions such as how the microbiome influences human health and disease.?

Under FAQs, we find: ?YES! You can definitely sequence your child, at any age. You will need to give your permission to have the sequencing done. If your child is over the age of 13, they will also need to give their assent (non-binding approval) as well as parental permission.? ?You will be able to opt-in to make your data available to the public.?

There is, not surprisingly, a medical disclaimer, ?uBiome is not a diagnostic test. However, we can give you valuable information about your microbiome that you can use to learn more about your health.? Then their site notes an upgraded kit, ubiome DELTA ^ FIVE, in which for $1,337 ?you can sample all 5 areas at 5 timepoints and see how your microbiome responds to your experiments???we hope to provide as useful and actionable data as possible.?

Ethical concerns

uBiome (and specifically @ventureJessica) sounds dismissive of the concerns of various bloggers but fails to either note that they are well-positioned to criticize or to respond directly to the substance of their concerns. For example, DrugMonkey is an NIH-funded researcher, who wrote, ?A little reminder of why we have IRBs. Did I mention it is still Black History Month??
Janet Stemwedel, aka @docfreeride, an Associate Professor of Philosophy at San Jose State University, raised other ethical and practical concerns.
Nick Evans, a bioethicist, writes about dual-use research, which might have both benevolent and harmful applications, and criticizes uBiome as a cautionary tale for citizen science.
DNLee, The Urban Scientist, leant a valuable perspective on the need for self-policing in citizen science.
Melissa Bates, PhD, a scientist in Pediatric Critical Care Medicine at the University of Wisconsin School of Medicine and Public Health, writes about Translational Research at BoundaryLayerPhysiology.com, and is clearly well-versed in research ethics as well as a thoughtful writer. Her criticisms, which mirror mine, included:
?1) Participation in the uBiome project requires the payment of a fee.
[Typically, research participants are not charged for participation, and thus are more free to withdraw consent without any penalties.]
2) There is no clear statement about what will be done with the data or samples.
3) There is no apparent plan for how your identity will be protected.
4) It?s not clear what conflicts [of interest] the major players in the project might have.
5) The benefits you?ll receive are grossly over-stated
6) There is no statement as to what your risks of participation are.
7) Children are included, but it?s not apparent how they are protected.?

IRBs

ComraddePhysioproffe (another NIH-funded researcher) provides great information about IRB ethics and oversight, and uBiome?s? IRB compliance (or lack thereof), among other posts.

Kelly Hills (@rocza), a bioethicist, and I co-moderated a session at Scio13 (Science Online) on ethics and citizen science, as part of a track that discussed potential problems with citizen science, including the difficulties obtaining IRB and ethical reviews. Holly Menninger (@DrHolly), I, and others hope to continue that discussion this year. DrHolly made an excellent comment about consent and citizen science. I have participated in two of her studies. In each case, there was a clear consent that could be a model of how things should be done.

Yes, there are problems with some IRBs, whether they are associated with academic institutions or are independent, for profit, enterprises. For example the University of Minnesota?s IRB has failed in its oversight of psychiatric trials there, as I have reviewed in the Markingson case. This included having an IRB chair who stated, shockingly, that the IRB is not responsible for protecting clinical trial subjects. Even the Johns Hopkins? IRB received scathing criticism for failures of oversight in an asthma study that led to the death of a healthy volunteer, Ellen Roche. The GAO has criticized the? workloads of IRBs as being too heavy precluding thorough review. This load on IRBs is well described in Trials and Tribulations. And IRBs are subject to conflicts of interest, as I also noted. I, too, have encountered questions as to whether an IRB approval was necessary for a given project.
But having at least an attempt at ethical and independent review is an important step, as is transparency. If there are flaws in the system, we should attempt to correct them, not ignore any attempt at oversight.

On the one hand, @ventureJessica seems to attempt being head of a naive young citizen start-up; on the other hand, uBiome has used their link to UCSF for PR and to UCSF?s legal team as an excuse for not having an IRB.

What uBiome?s management seems to be missing is that their skirting the rules hurts their image and fosters mistrust and, perhaps more importantly, may hurt the citizen science movement more broadly. Rather than whining about being misunderstood and mischaracterized, they should reflect on these criticisms?most from more experienced researchers?and try to respond. As a start towards openness, I would ask that they post their consent form?or do you only get to see that after you buy a kit? It is not just IRBs that need more transparency, Jessica.

Richman and Apte?s? IRB 2.0 is not a novel concept?there has been discussion about how to make IRBs more accessible to those not affiliated with academic institutions. There is likely widespread agreement that we need alternative IRBs and better standards for IRBs.

To return to the original question posed at TEDMED, ?Could a citizen scientist win a Nobel Prize??
Perhaps. But not for this.

Samsung nudges into BlackBerry?s territory, close to scoring U.S. government contract

Samsung?s plans to make its Galaxy smartphones enterprise-friendly seem to be bearing some fruit. The Wall Street Journal reports that Samsung is nearing a deal to supply mobile devices to the United States Navy and the Federal Bureau of Investigation, two U.S. government agencies that have high standards for mobile device security. The Journal?s unnamed sources say that although the deals have not yet been finalized, Samsung will likely secure a big order from the FBI and a smaller order from the Navy.

Samsung earlier this year announced its intentions to make a major push into the enterprise when it unveiled its KNOX mobile security suite aimed at showing businesses and governments that mobile devices based on Android could actually be secure enough to use for work. To that end KNOX?has several key enterprise features including?an application container that works similarly to?BlackBerry?s?Balance feature that separates work application data from personal application data; the ability to implement separate VPNs to individual applications rather than relying on one VPN for the entire device; and a security-enhanced version of Android that?s been customized to help IT departments enforce more than 300 IT policies and have access to more than 700 mobile device management APIs.

The Journal also notes that ?Samsung has invested heavily in its enterprise and government push, hiring executives away from BlackBerry, creating an enterprise-focused division within the company, and collaborating with third-party software firms to beef up the security on its devices,? so it seems that the company is taking its push into the enterprise very seriously.

Tornado watch and warnings downgraded to severe thunderstorm warning as of 3.55pm

Update at 6.20pm: Clean up under way after severe storm downs trees; some homes damaged, especially in Gravenhurst

Weather update as of 6:20 pm: Environment Canada has ended the tornado and severe storm warnings for Muskoka and Parry Sound. The public is encouraged to continue to monitor local media reports and be aware of changing weather patterns.

Widespread power outage is being experienced, a significant number of trees are down and extensive damage has been reported. ?Most roads are now passable but motorists are encouraged to watch for debris, hydro and clean up crews.

The public is advised to stay away from downed trees and wires.

The public is asked to be patient while crews work diligently to clean up the debris and return power to the affected areas.? Homeowners in Gravenhurst are reporting damage. Earlier this afternoon a downspout was reported in nearby Housey?s Rapids. There have been citizen?s reports of possible tornado activity in Gravenhurst. Those reports are unconfirmed.

At 3:20 EDT, meteorologists are tracking a line of severe thunderstorms extending from southern Lake Huron through Lake Simcoe and east northeastward to the Ottawa Valley and into Quebec.

These are dangerous storms. A roof has been reported blown down in the Petawawa area and trees have been blown down. Wind damage has been reported in Petawawa, Pembroke, Gravenhurst, Bracebridge, Barrie, and Coldwater.

At 3:20 EDT, meteorologists are tracking a line of severe thunderstorms extending from southern Lake Huron through Lake Simcoe and east northeastward to the Ottawa Valley and into Quebec.

These are dangerous storms. A roof has been reported blown down in the Petawawa area and trees have been blown down. Wind damage has been reported in Petawawa, Pembroke, Gravenhurst, Bracebridge, Barrie, and Coldwater. This is all resulting from an unstable airmass across Southern Ontario. Scattered thunderstorms are expected to continue this afternoon. Some of these storms will be locally severe. There is also the risk for isolated tornadoes. The greatest threat for isolated tornadoes will be over northern portions of Southern Ontario, including the Ottawa Valley. Hence a tornado watch has been issued for those regions.

One MNW reader called in to report a downspout in Housey?s Rapids near Gravenhurst. Power?s out and trees are reported downed on hydro lines there. In Bracebridge, some pockets are without power (for example, some stores on the east side of Manitoba Street were out of power at 3.30 pm and the traffic lights at Manitoba and Taylor were out while other traffic lights were on). Be careful out there!

Posted July 19, 11.10am: Just before 11am, Environment Canada has upgraded its severe thunderstorm watch to a tornado watch. This is an alert to the potential development of severe thunderstorms capable of producing tornadoes. Isolated tornadoes are possible this afternoon and early evening. Environment Canada recommends monitoring? weather conditions and listening for updated bulletins. Right now in Muskoka Lakes we are seeing high wind activity.

Here is more information provided from Environment Canada: At 11:00 EDT, meteorologists are tracking a line of severe thunderstorms likely producing damaging winds, large hail, and heavy downpours. There is also the risk for a tornado.

  • Emergency Management Ontario recommends that you take cover immediately, if threatening weather approaches.
  • Strong wind gusts and hail can damage property and cause injuries. Local downpours can cause flash floods.
  • Go indoors and move away from windows and skylights. Avoid areas of the building that could be affected by falling debris such as tree limbs. Stay on the lower floor of your home or building and if the storm is particularly severe go to the basement.
  • Avoid driving through water on roads. Even shallow fast moving water across a road can sweep a vehicle away.
  • Remember, severe thunderstorms can produce tornadoes.
  • In Canada, lightning kills up to 10 people every year. Remember, when thunder roars, go indoors.

China ends controls on bank lending rates

BEIJING (AP) - China said Friday it is ending controls on bank lending rates in a move toward creating a market-oriented financial system to support economic growth.

Reform advocates see an overhaul of China's interest rate policy as one of the most important changes required to keep its growth strong. Banks currently lend mostly to state industry rather than the entrepreneurs who create China's new jobs and wealth. Allowing banks to negotiate their own rates with borrowers could channel more credit to private enterprise.

"This is a significant development for China's financial sector in the direction of having interest rates determined by market forces rather than government fiat," said Mark Williams of Capital Economics in a report.

The scrapping of controls on lending rates is the first major economic reform under the government of President Xi Jinping, who took office earlier this year and faces a slowdown in China's torrid growth. Xi and other leaders have promised an array of changes but until Friday no details had been released.

"This reform is to further develop the basic role of market allocation of resources - an important measure to promote financial support for the development of the real economy," said a central bank statement. The change takes effect Saturday.

The end of controls could allow banks to charge lower rates to more credit-worthy borrowers, lowering costs for healthy businesses and spurring growth. Until now, the lower limit on lending rates was set at 0.7 times the state-set benchmark interest rate.

Private sector borrowers also might be able to get more access to credit by paying more. That could help to reduce their reliance on a vast, unregulated underground credit market.

Regulators allowed that market to flourish over the past decade to support entrepreneurs. But they have tightened controls over the past four years since discovering state banks were putting money into such unsupervised lending and taking on unreported risks.

Friday's move could foreshadow another significant change in the world's No. 2 economy - raising low rates paid to savers. There was no word on when that might happen.

Beijing has long used its banks to subsidize state industry with low-interest loans. Savers who had few alternative places to put their money were paid low rates on deposits that in recent years failed to keep up with inflation, meaning Chinese families lost money by leaving it in the bank.

That has suppressed household spending, which is among the lowest in the world as a percentage of the economy, and held back efforts to shift the basis of China's growth from exports and investment to more self-sustaining domestic consumption.

Chinese families looking for a better return on their savings have shifted money into more speculative investments in stocks and real estate, helping to fuel a boom in prices of both. They also have shifted money into "wealth management products," bundles of credit card and other debt that pay higher returns but that analysts worry might be too risky for household investors.

The performances and exhibits that will comprise the 2013-2014 Fine Arts Series at the College at Brockport were released Thursday.

Brockport is also excited to announce that they will offering online ticket sales. Starting August 19, tickets will be available via fineartstix.brockport.edu. Series events will go on sale approximately five weeks prior to the performance. Tickets will remain available online until 24 hours prior to the performance.

The series includes a diverse program of music(including the New York Klezmer Orchestra and the Rochester Philharmonic Orchestra, as well as one of the favorite local string ensembles, Gibbs and Main), dance(Danscore and Sankofa), theatre(Avenue Q and Almost, Maine) and art exhibits.

Google Cut More than 5,000 Jobs at Motorola in the Last Quarter Alone

Google has just presented its quarterly financial report and, tucked away at the end, as always, the company also provided a headcount. Up until very recently, that figure kept going up, as the company added more and more people to build the many things it is working on.

But buying Motorola changed that. One of the first priorities for Google, after paying the huge amount of money it did, was cutting down the fat. Motorola hasn't been profitable for years and, to change that, its new parent company has been slashing jobs left and right.

In its Q2 earnings report, the tech giant listed some 44,777 employees, 40,178 of which at Google itself and 4,599 at Motorola Mobile.

However, during the previous?quarter, Google indicated that it had 38,739 employees and Motorola 9,982. That seems to suggest that more than 5,000 employees were let go.

Some of them may have been moved inside Google, but there the headcount only grew by less than 2,000 people.

    Insecticide blamed for deadly India school meal poisoning

    Insecticide was in the food or cooking oil used to make a school meal that led to the deaths of at least 23 children in India, post-mortem results showed Thursday, amid reports that many victims suffered deadly convulsions and smelled of poison.

    Children began to fall ill within minutes of eating the free dish, a cook told Reuters from her hospital bed in Patna in the north-eastern state of Bihar.

    Death came so quickly for some that they died in their parents' arms while being taken to hospital.

    The school, in Mashrakh village in the district of Chapra, provided free meals under the Mid-Day Meal Scheme, the world's largest school feeding program involving 120 million children.?

    The state government has offered grieving parents $3,350 in compensation, according to an ITV News report.

    Investigators have seized a plastic container used to store the cooking oil, according to local media reports.

    Post-mortem results indicate insecticide was either in the original ingredients or the oil used to cook them, Patna Medical College Hospital superintendent Amarkant Jha Amar told the Associated Press Thursday.

    He said the results of chemical analysis of the ingredients seized from the school were still pending.

    Calls to the hospital were unanswered Thursday.

    The post-mortem appeared to confirmed earlier suspicions that the children had been poisoned by organophosphorus compounds used as pesticides.

    "The minute the children were brought in, we smelled this foul odor of organophosphorous," said Vinod Mishra, another doctor at Patna Medical College Hospital told Reuters.

    "It seemed as though it was coming out of their pores.?

    At least 23 children, aged four to 12, died after vomiting and convulsing from agonizing stomach cramps after eating the meal on Tuesday, Reuters said. Another local official told Reuters 25 children had died, but the toll could not be confirmed.

    Police were searching Thursday for the principal of the school, who has disappeared. Local media said school?s food was supplied by her husband, who runs a store in the village.?Residents said nobody else had reported getting sick from the same ingredients.

    Reuters said the meal was a potato curry and rice, while local reports said it was rice with soyabeans and lentils.

    School cook Manju Devi, whose own three children were reportedly among those sickened, told Reuters she had almost immediately fallen ill after eating the lunch.

    When asked if she had prepared it, her mother quickly intervened, saying, "No! She had nothing to do with the meal that day, another cook had made the meal that day. She wasn't a part of it."

    Police said there were many different versions of what happened at the school. "We have made no arrests so far as we are waiting for forensic reports which will help us piece together the entire investigation," Sujit Kumar, superintendent of police in Chapra, told Reuters.

    "We have circumstantial evidence but the key to the investigation is the headmistress who is absconding," he said, adding that police were trying to find her.

    P.K. Shahi, Bihar's education minister, said on Wednesday that the headmistress had been dismissed over the incident, although she has not yet given an account of what happened.

    Violent protests erupted in Eastern India following the deaths of 20 children who ate free school meals contaminated with insecticide. ITV's Sangeeta Kandola reports.

    "In spite of the cook's complaint (over the smell of cooking oil used for the food), the headmistress insisted on its use and the cook made the food. The children had also complained about the food to the cook," Shahi said.

    Protesters angered by the deaths threw stones at a police station and set ablaze vehicles Wednesday.

    Meanwhile, thousands of schoolchildren refused to eat their free school meals Thursday, according to an Agence France Presse report.

    The director of the midday meal scheme in Bihar, who gave his name only as Lakshmanan, told AFP: "Parents have warned their children to not even touch the meal served in the school. Some of the students dumped the lunch in school dustbins and we are trying to convince everyone that the tragedy will not be repeated."

    Contaminated school meal kills 25 Indian children

    PATNA, India (Reuters) - At least 25 Indian children died and dozens needed hospital treatment after apparently being poisoned by a school meal, sparking violent protests and angry allegations of blame.

    The children aged four to 12 fell ill on Tuesday after consuming a lunch of rice, soybean and lentils in the impoverished eastern state of Bihar.

    The school, at Mashrakh village in the district of Chapra, provided free meals under the Mid-Day Meal Scheme, the world's largest school feeding program involving 120 million children.

    Medical teams treating the children said they suspected the food had been contaminated with insecticide.

    "It appears to be a case of poisoning but we will have to wait for forensic reports ... Had it been a case of (natural) food poisoning, so many children would not have died," Poonam Kumari, local government administrator at the village, told Reuters by phone from Mashrakh.

    "The administration has helped cremate 21 children and, unfortunately, four more children have to be cremated," she said, adding that the remainder of a total of 48 children who consumed the contaminated food were being treated in Patna.

    "We feel that some kind of insecticide was either accidentally or intentionally mixed in the food, but that will be clear through investigations," said R.K. Singh, medical superintendent at the children's hospital in the state capital Patna.

    "We prepared antidotes and treated the children for organophosphorous poisoning," he said.

    Organophosphorus compounds are used as pesticides.

    The state government said it was investigating the cause of the disaster.

    ACCUSATIONS

    The school headmistress fled after the deaths became known and was dismissed, P.K. Shahi, Bihar's education minister, told a news conference.

    "In spite of the cook's complaint (over the smell of cooking oil used for the food), the headmistress insisted on its use and the cook made the food. The children had also complained about the food to the cook," Shahi said.

    The cook, who also fell ill after eating the food and was hospitalized, told Reuters television it had looked as if there was a layer of residue at the bottom of the oil jar.

    "I thought that this is locally-made oil as often there is an accumulation of residual waste at the bottom ... generally we get just about enough oil to prepare one meal, as there is no space for storage," Manju Devi said in Hindi.

    Opposition parties accused the Janata Dal party-led government of acting too slowly to hospitalize the children and dozens of people took to the streets to protest, television channels showed.

    Demonstrators pelted a police station with stones, set ablaze buses and other vehicles, chanted slogans denouncing the state government and burned effigies of Bihar Chief Minister Nitish Kumar.

    "I feel that the government completely failed vis-a-vis the evacuation of the affected children," said Rajiv Pratap Rudy, a spokesman for the main federal opposition Bharatiya Janata Party, said.

    "As soon as my boy returned from school, we rushed to the hospital with him," said Raja Yadav, the father of one schoolboy. "He was vomiting and he said his stomach was aching."

    Three of the children being treated in the hospital were in critical condition, doctors and Shahi said.

    Kumar has ordered an inquiry into the incident and has offered 200,000 rupees ($3,400) to the families of those who have died, state food minister Shyam Rajak said.

    Bihar, bordering Nepal, is one of the most impoverished states in India, according to government data.

    Kumar came to power in 2005, ousting a government which had been blamed for rampant corruption and sluggish growth in the poor eastern state.

    No longer are our devices lone islands that reach out into the void for content. Today they're supported by an array of services, perhaps most importantly those from the manufacturer that provide content to the user. That content spans typically spans a range of apps, music, movies, and television shows, and can include additional media like books, magazines, and more.

    The smartphone could function without the connections into these media pipelines, just as the gazelle can function just fine on a diet of grass alone. But throw in a few bushes with additional nutrients - or stores that open up movies and apps and music - and you're off to the races.

    But our ecosystems are hobbled by old systems digital, legal, and emotional. How do we move them forward, breaking the chains and allowing them to truly run free?

    Though Huawei seems to spend just about as much time denying spying claims as it does building handsets and telecom equipment, it's just taken that rhetoric up a notch. The company's vice president, William Plummer, just demanded the US and UK "shut up" about such allegations unless they can prove them. That's in response to a recent statement from former CIA head Michael Hayden, who accused the company of sharing "extensive knowledge of the foreign telecommunications systems" it worked on with the Chinese government. UK watchdogs also piled on, saying they would conduct a review of Huawei's new Cyber Security Evaluation Center over a lack of information about its links to the Chinese government. The beleaguered outfit responded that "these tired, unsubstantiated, defamatory remarks are sad distractions from real-world concerns related to espionage, industrial and otherwise." Those remarks show that Huawei's hit a whole new level of frustration, but given recent White House accusations against China, it's not likely to get any better.

    HOOVER | Vanderbilt comes into the 2013 season with more momentum than at any time in almost 100 years.

    The Commodores went 9-4 last season, finishing with seven straight victories capped by a victory over North Carolina State in the Music City Bowl.

    "Before we arrived Vanderbilt had been to four bowl games in 122 years," head coach James Franklin said. "We've been to two in the last two years."

    Vanderbilt hasn't won nine games in a season since 1915, so Franklin is in uncharted territory in the modern era. He doesn't want to rest on those accomplishments.

    "Those things are all things in the past," Franklin said. "Our focus is on where we're going now.

    "Probably our biggest challenging is handling success."

    Vanderbilt returns eight starters on offense, led by tackle Wesley Johnson and wideout Jordan Matthews. Austin Carta-Samuels, a transfer from Wyoming entering his third season in the Vanderbilt program, is the likely starter at quarterback, although Franklin said he doesn't believe in naming starters at any position until a couple of weeks of fall practice.

    The defense returns six starters, including cornerback Andre Hal. Also back is kicker Carey Spear, who was 14-of-14 on kicks inside 44 yards with two made field goals of longer than 50 yards last season.

    The Commodores will open the season with a nationally-televised Thursday night conference game against Ole Miss.

    "I think it's great for college football," Franklin said. "I think it's great for the SEC. I know it's great for Vanderbilt."

    Vanderbilt's out-of-conference slate isn't too ambitious. The Commodores host Austin Peay, UAB and Wake Forest, and visit Massachusetts. In addition to its divisional opponents in the SEC East, Vandy plays Ole Miss and Texas A&M.
